Kansas Courts Public Access Portal User Agreement
Overview and terminology
Electronic access to court information is restricted by federal and state law in addition to court rules and orders. Information on the Kansas District Court Public Access Portal and the Kansas Appellate Court Public Access Portal is made available as a public service under provisions in Kansas Supreme Court Rule 22.
The Kansas District Court Public Access Portal and the Kansas Appellate Court Public Access Portal, or Portals, offer remote access to public court records and information to the public.
A user must create an account to access the Portals. Any person or entity that accesses the Portals through a user account is a User under this Portal User Agreement.
The Portals are administered by the Office of Judicial Administration under the direction of the Kansas Supreme Court.
Information displayed on the Portals is not to be considered or used as an official court record and it may contain errors or omissions. Information accuracy is not warranted. You can obtain official records only from the court that maintains such official records.
Username and password protection
A username and password are required to use the Portals and to set up a user account. User agrees not to share the username and password with anyone. User understands and acknowledges they are responsible for all use or activity on the account, including account use by any third party, whether they authorize it or not. User agrees to keep their password secure. If User suspects their username or password may have been compromised, they must notify the Office of Judicial Administration immediately by email to ProdPortal@kscourts.gov.
Prohibited uses
User agrees to use the Portals only as permitted by applicable local, state, and federal laws. User specifically agrees not to:

knowingly alter, damage, or destroy the Portals or another User's computer system, network, software, program, documentation or data contained therein;

use any list of names or addresses contained in or derived from the records or information in the Portals for the purpose of selling or offering for sale any property or service to any person listed or to any person who resides at any address listed;

sell, give or otherwise make available to any person any list of names or addresses contained in or derived from the records or information in the Portal for the purpose of allowing that person to sell or offer for sale any property or service to any person listed or to any person who resides at any address listed;

use any device, software or routine to interfere or attempt to interfere with the proper working of the Portals or any activity being conducted on the Portals;

attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or making up the Portals; or
-
use or attempt to use spiders, robots, avatars, intelligent agents, or any other extraction or navigation search except for a normal browser.
If a User engages in one of these prohibited uses or otherwise engages in a fraudulent, abusive, disruptive or illegal activity, the Office of Judicial Administration may terminate the User’s account, at the office’s sole discretion, without notice to User. The Office of Judicial Administration may also report User’s activity to appropriate law enforcement agencies and take any other action that may be permissible under law.
Search limitation
A User is limited to performing 500 or fewer searches between the hours of 12:00 a.m. and 11:59 p.m. each day, Central Time. If a User exceeds this limitation, the Office of Judicial Administration will disable the User’s account. If a User account is disabled for this reason, the User may request their account be reinstated one time by contacting ProdPortal@kscourts.gov. If a User’s account is disabled more than one time due to a violation of this search limitation, the account will be permanently disabled.
Domain restrictions
The Office of Judicial Administration reserves the right to block new account registration from any domain that generates any User accounts that have been disabled for violations of this Agreement.
Warnings and limitation of liability
THE INFORMATION PROVIDED ON AND OBTAINED FROM THE PORTALS DOES NOT CONSTITUTE AN OFFICIAL RECORD OF THE COURT. This information is provided as a service to the public and is subject to change without notice. The information is provided "AS IS" without warranty of any kind, implied, express, or statutory, including but not limited to the warranties of non-infringement of third-party rights, merchantability, fitness for a particular purpose, and freedom from computer virus. The Office of Judicial Administration does not guarantee the accuracy, completeness, adequacy, or availability of the information on this website, and expressly disclaims liability for the information, including errors or omissions. The User assumes full risk and responsibility that the information provided may not meet their needs and requirements. The Office of Judicial Administration is not liable for any demand or claim, regardless of form of action, arising out of or incident to the posting of information or data on the Portals, the accessing or use of any information or data on the Portals, or the acts or omissions of any User or other person accessing or using any information from the Portals.
Jurisdiction
This Agreement shall be subject to, governed by, and construed according to the laws of the State of Kansas, and jurisdiction and venue of any suit in connection with this Agreement shall reside only in courts located in the state of Kansas.
Severability
If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect.
Assignment
This Agreement may not be assigned by User to another party without the prior express written consent of the Office of Judicial Administration.
Entire agreement
This Agreement constitutes the entire agreement between the User and the Office of Judicial Administration with respect to the Portals. It supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and the Office of Judicial Administration with respect to the Portals. The Office of Judicial Administration may amend this Agreement by posting the amendment (or an amended agreement) on the Portals. A User who uses the Portals after the Agreement is amended is accepting all changes included in the amendment or amended agreement.
Consent to conditions
Portal use is conditioned on acceptance of the terms, conditions, and notices contained herein without modification. User access and use of the Portals constitutes acceptance of these terms and conditions. User understands this User Agreement may be amended in writing by the Office of Judicial Administration and that by consenting to continued use the User accepts those terms and conditions.
